IRS INSTALLMENT AGREEMENT

When you have a tax debt and call the IRS, the IRS will immediately tell you what your payment will be. Most people will automatically go along with what the IRS has proposed. 

 

The amount the IRS is dictating is based on paying the tax debt in 60, 72, or 84 months. It does not take into consideration what the taxpayer can actually afford.

 

If you agree to an IRS payment plan that is doomed to failure, you will be back in default, facing a levy. Consult with an experienced tax practitioner before entering into an IRS Installment Agreement..

UNFILED TAX RETURNS

You have neglected to file your tax returns and now the IRS is sending you collection notices. Why would that be? Well the IRS has created a Substitute for Return (SFR) that creates a tax debt to collect.

 

An SFR is a grossly inflated tax debt and is usually twice the amount of what the tax debt should be. It will have "failure to file" penalties (25%) added to your tax debt.

 

An SFR can be challenged. An Audit Reconsideration is a process IRS uses when a taxpayer contests the SFR determination by filing an original (not an amended) delinquent return. Hire an experienced tax practitioner to reverse any SFR.

IRS HARDSHIP

(Currently not Collectible - CNC )

 

 

The IRS can and will place a taxpayer into Currently not Collectible (CNC) status (IRS Hardship) when it is proven that the tax debtor cannot pay their tax liability. The IRS will place a taxpayer (TP) in CNC for approximately 12 to 18 months before it needs to be renewed. During this time the Statute of Limitations (the time the IRS has to collect) continues to run out. It is possible that the tax debt will simply "go away."

 

The IRS, most likely, will file a tax lien but all enforcement will cease. Consult with an experienced tax practitioner.

IRS SETTLEMENT

(OFFER in COMPROMISE)
 
Many of the same financial criteria for CNC apply for an IRS Offer in Compromise (OIC). The main difference is that a TP must owe more than $10,000 in tax debt in order to settle with IRS.
 
The IRS has been approving approximately 40% of all OIC's submitted. Rejected OIC's are largely due to a TP deciding on DIY (do it yourself). It is always better when a TP has an experienced Tax Professional representing them.
